Patent Infringement Defenses for the Aftermarket

Description:
The aftermarket's legal defenses of patent exhaustion and permissible repair have been around for more than a century. However, there remain unsettled patent infringement issues that have only been recently resolved by a few significant rulings. Not all nuances have been settled but these rulings have significantly altered the scope of these defenses and may have widened the freedom to operate for the remanufacturing industry. This class will discuss such issues as: When does a patent get exhausted?, What is the impact of Quanta Computer, Inc. v. LG Electronics Inc. on the remanufacturing industry? and When can you rely on the concept of permissible repair when defending a patent infringement claim?
